Affidavit submitted before Misra Commission

            Affidavit of Shri Pal, aged 40 years S/o S. Harnam Singh, R/o 8, West Avenue, Punjabi Bagh.

            I, Pal Singh, do hereby solemnly affirm as under: -

1.                  When on 31-10-84, my family heard that our leader Smt. Indira Gandhi had been killed by bullets, the gloom spread in our entire mohalla and all of us condoled each other very much.

2.                  Next day, in the morning we were supposed to have Nagar Kirtan but it was cancelled because all of us were feeling very sad at he murder of our leader. The Gurdwara is next to our house. It is called Gurdwara Singh Sabha, Punjabi Bagh – New Delhi.

3.                  On 1-11-84, at about 11:15 O’clock AM. I was present in my house – with my family. We saw that a crowd, on foot, on cycles and on scooters was advancing rapidly and shouting, “Sare Sikhon Ko Un Ke Makkan Jalla Kar Aur Loot Kar Unko Jan Say Khatam Kar Do.” This mob after burning Guru Nanak Public School, was coming towards us.

4.                  This mob put our vehicles on fire and also set fire to Gurdwara Singh Sabha, Punjabi Bagh. They attacked us. When the mob tried to set our house on fire with fire balls, then to save our lives, I fired in the air from my licensed revolver, so that the mob may leave my house alone and go away.

5.                  On hearing my aerial fire, two DTC mini buses, the number of one of which was DHP 103, came. The mob got down from these buses. They were carrying iron rods, lathis, and white powder, which they were using to start fires. This episode lasted till 4 PM and we tried to call police by telephone. Once a police vehicle had come of its own at 2 PM. They gestured to the mob. “You carry on this job – you will not be touched at all.”

6.                  On 1-11-84, about 4 PM, I together with my family left the house by the rear entrance and saved our lives by taking shelter with the neighbours.

7.                  At 6 PM, CRP vehicle arrived. On that we reached the police station.

8.                  I suffered serious injuries due to stoning and fire – I requested SI Mahenderpal for arranging my medical examination and to record a statement of the loss suffered by me. But nobody paid any heed to me. They did not allow me to take any medical treatment till 2-11-84. On 3-11-84, I was medically examined and I was arrested under Cr. PC Sections 107, 157 and locked up.

9.                  On 14-11-84, I was released on bail by the Court. When on 23-11-84, I went to the police station to inquire about my truck stolen during the riots, I was locked up in the police lock up. On inquiry, I was told that a case under FIR 524/84 Section 302 IPC for the murder of a person had been recorded against me.

10.             Among the persons who set my house on fire were Ram Dhani, son of Jagan Nath, Saraswati Shishu Mandir, Jang Bahadur, son of Misal Chand, Mohan Lal son of Chhotey Lal, 160 J.J. Colony, Mangolpuri.

11.             My house and my vehicles suffered due to the connivance of the police with the mob. Police never helped us. On the contrary, they behaved like an enemy towards me.

12.             All these episode were witnessed by my wife and some neighbours amongst whom Kuldip Singh, my next door neighbour and his family member are included.
