Affidavit submitted before Misra Commission

                Affidavit of S. Raminder Singh S/o Raja Singh, aged 50 years, resident of Jharoda Kalan, Near CRPF Camp, Delhi-72, presently residing at C-8A, Fateh Nagar, Jail Road, New Delhi.

            I, the above named deponent do hereby solemnly affirm and state on oath as under: -

1.                  On 1-11-84, at about 2 – 3 PM, a Haryana Roadways bus stopped near my house. The bus was fully loaded by men. Those men alighted from the bus. They had iron rods, lathis and tin boxes (like buckets) with them. Our neighbours made them hand folded requests not to do anything there. These neighbours included Chowdhary Rajinder Singh, the President of our association. Repeated persuasion by these neighbours had its effect and those Haryanvi men left the place after warning that they are sparing now but they would not spare again.

2.                  I am an ex-inspector of CRPF. The CRPF camp is near our house and I remained in that camp for five years. After the aforesaid mob had left, I went to CRPF camp. At that time R.P. Naik, Om Parkash was on duty at the gate. At that time Asstt. Commander J.S. Gelhot Sahib. I told him that the lives of my family are in danger and that he must make some arrangements. Shri Gelhot knew me well because even after retirement I used to visit to CRPF Camp. My house is situated just opposite the CRPF Camp. After my several requests Gelhot Sahib asked me to go to my house and he will arrange to send protection to my house after getting the permission from the Additional DIG Mr. Mohindroo. I cam to my house.

3.                  When I reached home, Chowdhary Rajinder Singh and some other persons were also standing near me. They advised us to go to their house fearing that the mob people may came again. Chowdhary Rajinder Singh’s house is far off my house, about one and half kilometer away. Therefore we did not think it proper to go to such a distant place. I was also sure that Mr. Gehlot will send force to protect me.

4.                  When we refused to go to Chowdahry Rajinder Singh’s house, the later advised us to go to CRPF Camp because of it was not safe for us to stay there. I, alongwith my children, my younger brother S. Harbhajan Singh and his family went to the camp. My two Hindu relatives namely Head Constables Inderpal of 13th Battalion Ajmer and Head Constable Daya Ram Yadav 23rd Battalion Patna (who now is a Sub-Inspector) who also resided there were on duty outside Delhi. I thought that the mob may harm them thinking them to be Sikhs and therefore I took their families also with me to the Camp. Choudhary Rajinder Singh and some the people also accompanied us upto the camp.

5.                  When we reached the gate of the camp we asked Rajinder Singh and other men to go because we were safe now. At that time CRP Naik Om Parkash and Sub-Inspector Prem Singh Bisht (who is an Inspector now) were standing at the gate. They made us stand on one side and did not allow us enter the camp. They told us that we cannot go in. At that time Group Commander (Additional DIG) Sh. Satish Kumar Mahindroo was standing alongside Assistant Commandant J.S. Gelhot. I requested Sub-Inspector Bisht and Naik Om Prakash to let me go as I wanted to a talk to Commandant Mahendroo. IN the meantime Commandant Mahendroo and Mr. Gelhot came towards me. I proceeded ahead, met them and narrated the entire incident. But Commandant Mahendroo said that it was not a Refugee Camp. He said, “We cannot allow you to come in because you are civilians.” I begged them to have mercy because I served there for five years. I requested them to allow us sit near the wall. But they said that they have orders from the Directorate and cannot render us any help at all. Then I sought their permission to allow us sit under the tree outside and we will not enter the Camp. I told them that I myself planted this tree. But they flatly refused and saying that they have orders from Directorate and cannot help us at all, became angry. Then I begged them that at least the families of those CRPF men who are in service and are Hindus must be protected because there are young girls and small children with them. But the Commandant Mahendroo refused to help them also. Then they gestured us to cam out and they themselves also came out of the Camp. Then they asked me as to where my house was. I pointed towards my house. They said, “The house is not on fire. All the people are roaming about. Go to your homes.”

6.                  We all came to our homes. After some time the mob came in buses. All of us (the four families) assembled in a room and bolted the same from inside. The main gate of our house is made of iron and the mob tried to break it. We had put our lock there. My brother had a licensed gun. He fire in air to frighten the mob. They got frightened and retreated a bit. The mob continued attacking our house for about four hours. In the meantime mob came in more trucks and buses. A matador tempo arrived in the meantime and the Councilor of Najafgarh Ram Narayan Verma was in the tempo. I know him personally very well. The tempo was driven by aboy and my brother told me that he is the son of Ram Narayan Verma. This tempo was full of men who were having iron rods etc. in their hands. Ram Narayan Verma had a talk with the men in the mob. He stayed there for some time and then went away after off loading some men.

7.                  Many private and Haryana Roadways buses came and brought more people. These vehicles used to stop near my house. Some people used to alight and some board the vehicle and go elsewhere.

8.                  On boy named Pappu, who is the younger brother of Gyan (owner of Najafgarh Petrol Pump) came on his motorcycle alongwith one other pillion rider and he said to the mob, “Came with me. I will give five liters of petrol to each of you.” The mob got this petrol and set on fire the door of the shop outside. In the meantime they had managed to break open the lock of the main gate and came in and set the house ablaze. They tried to break open the door of our room by iron chisels. By that time my brother fired a shot in air through the window. They got scared and fled.

9.                  This commotion continued upto 8 PM. At about 8 PM, a jeep came and few men alighted from it. The had a torch in their hand. They came in and shouted, “Police, Police.” I asked them to throw the torch light in their faces so that we can ascertain their identity. When they threw the torch light on their faces, then I recognized them. They were SHO Rana Hawa Singh, alongwith CRPF Commandant Satish Kumar Mahendroo, Asstt. Commandant J.S. Gelhot, MTO Kaushik and Sub-Inspector Bisht and Naik Om Parkash. On recognizing them we opened our doors, came out and sought their help. Then Rana and Mahendroo asked us to run away from there. I requested and enquired from him as to where we should run, then he asked Rana to tell us. There upon Rana said that we can escape by getting our hair cut. Then I enquired as to whether there is any guarantee that we can save ourselves by getting our hair cut because everybody recognizes us. Then Rana said, “As you wish”. After saying this he left the place in his jeep. But Mahendroo and his party remained there. We saw that there were 4 – 5 other armed CRPF men standing on the road. I requested Mr. Mahendroo to save the Hindu families as there were the families of CRPF personnel who are in service. Then Mr. Mahendroo summoned one of his CRPF Jawan and requisitioned a vehicle. He immediately ordered and the vehicle arrived there. Both the families and their children were made to board the vehicle and their belongings also loaded therein. They did not allow any of our family members to board the vehicle. I requested him to take our three young daughters in the vehicle but he flatly refused. Hardly had the vehicle started that a bus full of hoodlums came shouting there. At that time we were standing outside. We got scared. At that time my children ran towards the wall of the camp. A CRPF sweeper was standing there. He lifted the children and over the barbed wire fence, threw them inside the camp. I ran and boarded the running CRPF vehicle. But one stone hit me and blood camp out of the injury. My brother could not board the vehicle and the mob grabbed him. I came to know in the morning that they had killed my brother and his dead body was lying on the road outside.

10.             At that time there was a force number about 2000 men in the camp but even then the CRPF did not make any attempt to save my brother. So much so that they did not care to pick up the dead body of my brother through it was lying just in front of the camp.

11.             The persons who killed my brother included Rajpal and Bheem (both sons of Maha Singh), Prem and Jeewan (both sons of Sees Ram), Bimal and Prem Singh, who is brother of Ram Pal washerman and resides in Jharoda Kalan.

12.             On 1-11-84, when I went in the CRPF Camp, I had deposited my sword and 20 rounds. Afterwards when I went to get these things back, I got four “spent” rounds, sixteen unspent and my sword was also broken. I myself got there things entered at the CRPF gate.

13.             On 1-11-84, at 3 – 3:30 PM, when we tried to enter the camp to save our lives, we were denied entry. But at the same time two trucks belongings to the two sons of Sub-Inspector Om Parkash were allowed to enter the camp. In these trucks there were drivers and conductors as well. I myself saw that these trucks remained parked inside the CRPF Camp, in front of Block No.8.

14.             I requested Gelhot Sahib to help me bring in the dead body of my deceased brother so that I may perform the funeral. He directed me to meet him in the office. When I went to his office, M.P. Singh DSP (Company Commander) and Shri Kaushik was also there. Shri M.P. Singh said taht the police had already taken away the dead body though at that time the dead body was lying on the road. He also directed us to go away from there and not to roam about there. This happened on 2-11-84, in the morning.

15.             On 2-11-84 at 11 – 12 AM. I came to know that during my absence my household articles had been looted. Those persons who had looted the goods from my house included Sub-Inspector Prem Singh Bisht, Head Constable Amrik Singh, Naik Om Parkash and Contable Bashir Bhatt. My tenant Shri Jairam’s wife and the family of Inderpal were in the same vehicle in which our looted household goods were brought. The looted goods included a licensed 12 Bore Single Bore gun belonging to my brother.

16.             The following were also among the mob: -

a.     Chand S/o Hari Singh, residing at Jharoda Kalan.

b.     Maha Singh alias son of Hathni, r/o Jharoda Kalan.

17.             I remained in the CRPF camp till 5-11-84. On 6-11-84, DIG Mahendroo gave me four security guards and asked me to go to the Relief Camp. I went to Najafgarh Police Station escorted by these four security guards and asked the Duty Officer there to lodge my report. Duty Officer Shri Ram Chander refused to my report. But, on the contrary he got procured my signatures on blank papers.

18.             I  came to know that the goods looted Bashir Bhatt from my house included my photo album also. In that album there were some photographs of Director General B.B. Misra and Director General Imdaad Khan. My photographs are still in his house. If his house is searched the photographs can be recovered. He will not be able to explain these photorgraphs but I can.

19.             Police lodged my report on 23-11-84.

20.             I got the Post Mortem report of my deceased brother on 23-11-84. This report is wrong.
