Affidavit submitted before Misra Commission

I, Balwant Singh S/o Shri Budh Singh, aged about 44 yrs., R/o RZ-4B, Mohan Nagar, Nangal Raya, New Delhi-110046, do hereby solemnly affirm and state as under: -

1.                  That I say that I was the resident of Nangal Raya from the last 13 yrs. I was carrying on the business of building material in Nangal Raya and as such I was acquainted with the people of my area.

2.                  That I alongwith my wife and my son aged 11 yrs. who is handicapped by birth were sitting in my house on 31st October, 1984, evening and we were all aggrieved on the death of our Prime Minister. While I was at my residence, we were told by the people in my neighbourhood about certain stray incident of violence, which took place in and around the Medical Institute and South Extension areas. At about 9 P.M.. I was told by wife of my friend Mr. Uma Shankar who is also of Nangal Raya, that a bigger mob was coming to our area to kill the Sikhs and to loot their properties. I got frightened from this and I climbed to the roof of my house with my family. From there I saw that Gurdwara D-Block, Janakpuri, adjacent to Nangal Raya was burning and thereafter, the mob started moving towards Pankha Road and started looting and burning the shops belonging only to Sikhs on Pankha Road in a very systematic manner, while leaving the shops of others (Non-Sikhs). That certain shops, whose names are Shalimar Tent House and Wassu Paints etc, belonged to Sikhs were looted and burnt. This created a further panic in me. At about 10 the said mob reached my house. They broke open the iron grill which was fixed on the gate of my house by iron rods, which the mob was carrying. The mob was shouting slogans. The mob was carrying cans of petrol, kerosene oil and also white powder, which used to ignite instaneously besides iron rods, lathies etc.

3.                  That all this time I was hiding on roof of my house and was witnessing all this. In the mob I was able to recognize the following persons who belong to Congress Party; and were in the forefront: -

1)     Capt. Hira Singh (Retd.)

2)     Narender S/o Sita Ram

3)     Narender S/o Raghbir Singh (Nephew of Lok Bir Singh)

4)     Tejinder Singh S/o Randhir Singh (Nephew of Lok Bir Singh)

5)     Dharmender alias Baboo, Three-Wheeler scooter Driver S/o Amar Singh

6)     Pinkoo S/o Sh. Ram Saran, A- Tent House, Pankha Rd., New Delhi.

7)     Ram Singh, Pandit, R/o Ram Niwas - Property Dealer.

8)      Mahender, Harijan of Brahmpuri (Pig shop owner)

9)     Bhim Singh, Tailor, R/o Mohan Nagar, Nangal Raya

10) Jag Mohan, R/o Mohan Nagar, Nangal Raya

11) Birju S/o Rohtas Malik

12) Naresh S/o Roop Narain.

The mob which was predominantly of local people started looting my house. It is pertinent to mention that I own 10 shops adjacent to my resident which were all rented out to Hindu people and none of these shops was looted or burnt. One of my tenant Bhim Singh, Tailor above mentioned was leading the mob. The mob after looting the goods from my house set the same on fire. As soon as the house was set on fire, we sneaked to the house of our neighbour on our back side, Mr. Monga had stayed there the whole night with my family. The whole night the mobs were ravaging the area and air was full of shouts screams and the skyline was glowing with the burning of fires.

4.                  After viewing the whole situation, I thought that we should move to a more safer place. I then alongwith wife and my son whom I carried on my shoulder being handicapped at about 8 A.M. in the morning of 1st November `84, moved to the house of Col. A.S. Waraich (Retd.) who also resides in Nangal Raya at 101/6, Mohan Nagar. At about 9 A.M. on the same day, I had seen and heard Satya, Proprietor of Satya Opticals shouting on microphone that any Hindu offering shelter to any Sikh would also be killed.

5.                  That when we reached the house of Col. A.S. Waraich, at that time two cars and one jeep (Nissan), all belonging to the army were standing there. I was told by Col. Wariach that he had rung earlier to his brother, who was serving in the Army had come with two cars and jeeps and army personnel to remove the family members to a safer place. After half an hours time the brother of Col. Wariach alongwith Col. Waraich, three daughters of Col. Waraich, my wife and my son and Maj. Toor’s wife and his son all went away to Maj. Toor who was relative of Col. Waraich. That after that myself, Maj. Toor, Col. Waraich’s wife and the servant of Col. Waraich, Narain were left behind. We people were left behind since there was no space in the Army cars and jeeps.

6.                  That about after half an hour’s time after Col. Waraich and other had left the mob mainly consisting of local people and mainly young people being led by the same people as above-named again came. At that time myself and Maj. Toor were standing on the stairs leading to roof and could see through the cement grill the mob coming towards our house. They were shouting slogan that “In Sikh Gadaron Ne Hamari Ma Ko Mara, Ab Hum In Ko Mare Ge”. Capt. Hira Singh at that time was saying that “Burn the Sikhs alive.”

7.                  That the mob was armed with sariyas, lathies, cans of kerosene oil and petrol and white powder. They broke open the outer gate of Col. Waraich with sariyas. They started beating the servant Narain and even wife of Col. Waraich. They were all shouting to know that where are the Sikhs hidden and started breaking open the door of the rooms and then threw kerosene oil and put fire to them. At that time we, (myself and Maj. Toor) thought of running from the house. We jumped from the roof of the house from the backside and started running towards ‘D’ Block, Janakpuri. We were chased by the mob on the Pankha Road. I would like to mention that at time I saw policemen belonging to the Delhi Cantt., P.S. on the road but they made no attempt to stop the mob.

8.                  That the mob thereafter started pelting stones at us. We ran towards the houses of D-Block, Janakpuri. We tried to enter one house but the Hindu house-owner refused to allow us inside. I immediately ran into an opposite house and climbed onto the stairs. Maj. Toor was lagged behind was stoned down by the mob. I was standing and seeing from the cement grill in stairs and was seeing the harrowing scene. Maj. Toor thereafter was hit on head by sariya and then burnt alive by putting petrol and fire by the mob. At that time, Pinkoo S/o Ram Saran, Narender S/o Sita Ram, Dharminder & Baboos and Naresh S/o Roop Narain named above, were saying to Amar Singh that search for other Sikh Balwant Singh, i.e. myself be made and said “he too should not be spared.” I could stand no more and started jumping from one roof top to another which were connected and finally I got into the house of a Hindu gentleman who hid me in his house.

9.                  That the whole day I stayed in the house of the Hindu gentleman after cutting my hair & beard.

10.             That I can recognize and identify each and every person whom I have named herein-above and  A.M. willing to depose against all those persons as and when an opportunity is given to me.
