Affidavit submitted before Misra Commission

                AFFIDAVIT OF S. PIARA SINGH S/O S. RAM LUBAHYA SINGH AGED ABOUT 43 YEARS, R/O F-8, VIKASPURI, NEW DELHI 

      I, the above named deponent, do hereby solemnly affirm and state as under: 

  1. That on 1st November, 1984, I received a telephone message from my friend at Mayapuri Industrial Area, that the mob is destroying the property by way of looting, arson and setting fire to the properties. The applicant also has a shop in the said area and in order to protect the property the applicant immediately rushed to the Mayapuri Industrial Area on scooter where the mob was looting and destroying the property of the Sikh community. When the applicant reached at his shop he found that some of the shops and industries were burnt by the said mob and the mob were disappeared from the place upto that time. The shop of the applicant were safe, hence the applicant immediately came back to his residence at Vikaspuri.
  2. The applicant was coming back to his residence via Subhash Nagar and when the applicant reached at the crossing of Subhash Nagar, he saw the mob of about 50 persons were coming towards him shouting “Pakro Sardar Ko.” The applicant, out of fear rushed towards Tilak Nagar, and when the applicant reached at the water tank of Tilak Nagar, he saw policemen standing with arms and one of them showing pistol to the applicant to “go back otherwise I will shoot you.” The applicant turned back and saw at Subhash Nagar crossing side that mob was coming. The applicant with a view to get the protection, entered in the premises of the Police Station Tilak Nagar.
  3. That applicant was told by the police officials of Police Station Tilak Nagar, to go inside and sit in a particular room pointed out by them in the Police Station. The applicant went inside the room and saw about 7 Sikh persons were already sitting there. Sh. Babu Lal, ASI and one another a policeman started beating the applicant with Danda & kicks. Sh. Babu Lal, ASI told to burn the beard of the applicant by candle. Shri Sat Pal Saini another policeman / official told the applicant that I being a Sikh have shot Prime Minister and now the applicant shall be taught lesson for the same. Shri Khazan Singh another policeman / official caught hold my hair and kicked me. On this the applicant fell down on the earth. The applicant requested the police officials that he is innocent and he has done nothing, but the police officials confined me in that room upto late hours and then they falsely implicated me in a false and concocted criminal case under section 147/149/149/188/436/427/395 IPC and FIR was registered as No.442 dated 1-11-84 and the applicant was sent to the Jail.
  4. That at the Jama Talashi the policeman / officials took six hundred rupees, one wrist and other articles from his person and later on when the applicant was released on bail and ordered for the return of Jama Talashi by the Magistrate, the police officials only offered Rs.60/- to the applicant in place of Rs.600/- for which the applicant already complained the matter to the DCP, at Tilak Nagar.
  5. In view of the above stated facts and circumstances, it is respectfully prayed that a serious impartial inquiry be made and a strict action be taken against the police officials.
