Affidavit submitted before Misra Commission

I, Major N.S. Phull, AMC (Retd.) S/o Late S. Jodh Singh Phull, aged 64 yrs., R/o WZ-91E, Shiv Nagar Extn., Jail Road, New Delhi – 58, do hereby solemnly affirm and declare as under: -  

  1. I submit that after 37 yrs. of meritorious service in the Indian Army I retired as Major on 1st February,1977.
  2. On 1st November,`84, at about 14 – 15 Hours in front of my house-cum-shop I stopped a police van seeking for help in order to get more reinforcement of  police for saving us from burning and looting of shops by the mob. DCP (West) Shri U.K. Katna told his men to put me in the van and took me to Police Station, Tilak Nagar. There were already 8 Sikh gentlemen and one Hindu gentleman seated on the ground in the special room of the Duty Officer and one more Sikh gentleman was brought later on. Shri G.P. Singh, Shri Rana Malhotra and Mrs. Pritam Singh Marwah of the locality are witnesses to this incident.
  3. That we were made to sit till 19:30 hrs. when Sub-Inspector Babu Lal came and asked for Jama Talashi. I deposited my licensed pistol No.815904 with ammunition, cash of Rs.314/- and asked for receipt. I was not given the copy of Seizure memo and instead beaten and thrashed, put in the cell behind the bars, alongwith other ten persons.
  4. During the night one policemen Khazan Singh came and announced “Commissioner Saheb has told that if Major Singh can produce the license he should be let off.” I told him that I have license kept at my home and can show them.
  5. On this pretext I was taken out of the cell and beaten mercilessly till I asked for a doctor when they put me back in the cell with injuries on my right eye, back and right hand. The offending officers were SI Babu Lal, ASI Attar Singh, Policeman Khazan Singh and many other whom I do not recognize. I was examined by M.O. in Central Jail and injuries are recorded in the Jail register against Sl. No.9938 dated 3rd November`84.
  6. Next day I was asked to sign a fresh slip mentioning only the cash of Rs.314/- and not my pistol and ammunition. I refused to sign as I said that I had already signed the Seizure Memo on 1st November`84, but I was made to sign forcibly by Sub-Inspector Sat Pal Saini accompanied by a policeman. We were then taken to Tis Hazari Court and Central Jail from where I was released on bail on 9th November`84.
  7. While in Jail we came to know that we all eleven persons have been implicated as a group in P.S. Tilak Nagar in false and concocted charges under various sections of IPC e.g. Vide FIR No.442 of 1984 of Tilak Nagar P.S. in which I was shown as a leader holding my pistol in my right hand leading the other persons for looting, plundering and what not.
  8. The police officials had deliberately and maliciously made me a target as I was responsible citizen of locality with good background and believer in principles of ten Gurus.
