Affidavit submitted before Misra Commission

                     I, Gurcharan Singh S/o S. Kirpal Singh, aged about 62 yrs., R/o H-I/57, Lajpat Nagar, New Delhi-24, do hereby solemnly affirm and state as under: -  

1.                  That I am running my own Tourist Transport Service at Gurdwara Shri Guru Singh Sabha Shop No.3, Lajpat Nagar-I, New Delhi and had a fleet of four new Ambassador cars under registration No. DLY-473, DLY-474, DLY-475 and DLY-807.

2.                  That I am elected member of Delhi Sikh Gurdwara Management Committee since 1978 and  I A.M. working as a General Secretary of Shri Guru Singh Sabha (Regd.), Lajpat Nagar since its inception and I am  also working as Manager of Shri Guru Singh Sabha High School in Gurdwara premises since this school was started in 1962.

3.                  That on 31st October 1984, at 9 P.M., I came to know from people in the locality that in INA market on Ring Road some Sikhs have been attacked by Congress workers and similar attacks were anticipated in Lajpat Nagar also. Few miscreants came in Tempo and attacked Gurdwara Sri Guru Singh Sabha, Lajpat Nagar at night between 31st October & 1st November`84 at 12:30 A.M.. Some persons attempted to put the building on fire by pouring kerosene oil on main door and windows. I was informed by my driver at my house. On hearing this I alongwith some persons rushed to Gurdwara. We shouted at those rioters and then rioters got into the tempo waiting there and sped away. Thereafter, I rang up the P.S. Lajpat Nagar and asked for protection. After about half an hour the SHO came in a jeep and on my request, he deputed 5/6 policemen in front of Gurdwara. After putting off the fire I went home at night.

4.                  That on 1st November, 1984 morning following persons came to Gurdwara at 9 A.M. and saw the damage done during the past night. The cash in Cash Box of Gurdwara offering was counted as Rs.4,400/- and was kept with the Secretary for custody. I kept this in my shop no.3 immediately. Following persons were present: -

1)     Jasbir Singh of C-I Block,

2)     Tarlok Singh of C-1,

3)     Jawand Singh,

4)     Balwant Singh

5.                  That at 10:30 A.M., on 1-11-84, a mob led by Shri Himmat Rai (Congress worker) and brother of Sh. T.R. Malhotra, member, MCD and Shri Sain Ditta Mall of B-I/164, Lajpat Nagar came from Post Office side. The mob was comprising of 150/200 persons mostly of Jhuggi Jhopri and few miscreants from Lajpat Nagar, New Delhi were as under: -

1)     Vijay Kumar Anand S/o Sh. Inder Sain Anand, r/o C-I/147, Lajpat Nagar, New Delhi.

2)     Kala S/o Sh. T.R. Malhotra, Member MCD, Delhi.

3)     Harish S/o Sh. Bhawan Das, H-Ist Block, Lajpat Nagar, New Delhi.

4)     Nandu, H-I/104, Lajpat Nagar, New Delhi.

The mob was armed with iron rods, petrol cans, kerosene oil, lathis and some powder, stones etc. and most of the persons were armed with same type of lathis, iron rods etc. and came from Post Office side. These rioters were brought in buses which were parked near S. Avtar Singh’s house in E-Ist Block Lajpat Nagar and these buses were seen by S. Avtar Singh and others and the rioters were taken by local leaders to Gurdwara.

6.                  The mob started throwing stones at the Gurdwara. Sh. Himmat Rai was shouting near the Gurdwara and was directing the mob and Vijay Kumar Anand to put Gurdwara on fire. Gurdwara and two shops were set on fire by pouring kerosene oil ,powder and petrol. At that time following Sikhs were present in the Gurdwara building and ran to third floor for safety: -

1)     Gurcharan Singh, H-I/57,

2)     Jasbir Singh, C-I/65,

3)     Surjit Singh, C-1/14,

4)     Granthi Joginder Singh,

5)     Malvinder Singh,

6)     Mohinder Singh,

7)     Balwant Singh, Peon,

8)     Amarpal Singh Sewadar and two women.

The mob stoned the Gurdwara and set the Gurdwara, shops on fire and four Ambassador cars in the presence of Sh. V.P. Rana, Sub-Inspector, Police and other five / six policemen. The police remained silent spectator. The mob burnt down the front portion and entered the hall and burnt down carpets, windows, show cases, Almirahs, electric fans, fittings, Roomalas, musical instruments etc. and damaged walls, floor and marble stage (Palki) with iron rods. Two photographs are attached showing the Kupwara building burning and some miscreants including Vijay Kumar Anand (Billa) and Kala Malhotra and others are standing nearby and can be identified.

7.                  The mob was roaming and damaging all movable and immovable property of Gurdwara. My own shop, office Gurdwara records, cash amount of Rs.4,400/- of Gurdwara, Rs.3,500/- of Singh Sabha School, records of School, my professional and business papers, account books were all burnt down. My four Ambassador cars bearing registration Nos.DLY-473, 474, 475 and DLY-807 were set on fire by the mob and damaged. The police party during that time were heard saying ‘Jo Kutch Ho Sakta He Karo” and this police party went away thereafter. I informed SHO Lajpat Nagar P.S. and after great resistance and persuasion FIR was registered and some police personnel posted opposite Gurdwara.
