I, Khushdev Singh Bindra s/o Sardar Singh Bindra, aged about 32 yrs., r/o H.No.13, Hari Nagar Ashram, Near Shalimar Cinema, Near Raziya Building, New Delhi-14, do hereby solemnly affirm and declare as under on oath: -

1.                  That I am residing here since 1965 and am carrying on the business of running auto vehicles.

2.                  That on night of 31-10-84, two Congress (I) workers namely 1) Balecha who runs a primary school in Siddhartha Basti (opposite Sunlight Colony) Ashram and 2) Ashok Kumar alias Nikku, r/o Dhobi Basti (behind Shalimar Cinema), Ashram after getting fixed two search lights in the nearby Lal Singh Park held a meeting of other workers. There they shouted Anti-Sikh slogans like “Sikh Gaddaron Ko Khatam Karo – Khoon Ka Badla Khoon etc.” and incited them to kill the Sikhs in India.

3.                  That on November 1, 1984, in a morning a strong mob armed wit lathis, iron rods, knives etc. came in my house. Apprehending danger to my life I sought refuge in the house of my Hindu friends Sh. Ashok Bhatia just opposite my house. At that time I group of persons making lot of noise near the park nearby. I could recognize the following persons who were leading the unlawful association: -

                                i.            Balecha, a Congress (I) worker of the are who runs a school in Siddharth Basti (Opp. Sunlight Colony) Ashram.

                              ii.            Ashok Kumar alias Nikku, a Congress (I) worker of the area, r/o Dhobi Basti, Ashram.

                            iii.            Mr. Yadav SHO of the Srinivaspuri, Delhi.

                             iv.            Sham, r/o 180, Hari Nagar, Ashram.

                               v.            Kishan brother of Sham, r/o Hari Nagar Ashram.

                             vi.            Bedi, r/o Ashram ( He was wearing a police uniform and having a revolver).

                           vii.            Chander, r/o Nehru Nagar.

                         viii.            Chander, r/o 181, Hari Nagar Ashram.

                             ix.            Inder brother of Chander, r/o Hari Nagar Ashram.

                               x.            Prithvi owner of coal depot in Ashram.

4.                  That these person mentioned in the preeciding paragraph attacked my house. I saw the whole incident from the house of Sh. Ashok Bhatia where I had hidden myself. They looted my house entirely and also set on fire my scooter No. DHR 632, SHO Yadav was actively instigating other people to kill Sikhs and loot their propeties. He was in his full uniform and took no action whatsoever to stop the unlawful assembly from its illegal acts. Photocopy of complaint lodged with P.S. is annexed herewith.
